General Terms and Conditions & Data Protection​

“My Vegan Box” is a site of the Individual Reason My Vegan Box Angéline Cousineau, 1700 Fribourg (hereinafter “My Vegan Box”). Its offer is limited to the territories of Switzerland. These General Conditions of Sale (hereinafter after “GTC”) apply to all My Vegan Box services.

My Vegan Box’s activity is the distribution to its Customers of a box containing vegan food products and various accessories from partners of My Vegan Box. This offer is only accessible from the website www.my-vegan-box.ch.

The purpose of these Terms and Conditions (hereinafter “T&Cs”) of My Vegan Box is to define the rights and obligations of the parties in connection with the sale of the My Vegan Box service and products to Customers of the website www.my-vegan-box.ch (hereinafter “site” or “website”). They apply, without restriction or reservation, to all sales of products and services offered by My Vegan Box on its site. By validating and confirming his/her order, the Customer declares to have read, understood and accepted without reservation the terms of his subscription or his/her order, as well as all of these general conditions of sale (hereinafter “GTC”). .

These T&Cs are originally written in French and translated in English for the Customer easiness of reading. The French version is the version that is legally accepted by the Customer. The translation is just given as an information service. The Customer has the option of saving and printing them. These T&Cs are subject to Swiss law and the Swiss standards in force. My Vegan Box reserves the right to modify these General and Specific Conditions of Sale at any time, without notice, and without informing the Customer, it being understood that such modifications will not be applicable to orders previously accepted and confirmed by the Customer.

Orders refer to any purchase made on the My Vegan Box website: subscriptions, gift cards, corporate boxes, products from the online shop etc…

When ordering, the Customer must ensure the accuracy and completeness of the data you provide. It is very important to provide us with accurate delivery details to ensure the Client’s order to be delivered on time.

The subscription consists of the shipment, each calendar month, of a “vegan box” including food products, accessories and cosmetics.

The first box will be received the month after the first order and payment has been made. Refer to “Article 11. Shipping” for further information.

Each type of subscription (monthly, bi-monthly, quarterly, half-yearly and yearly) subscribes the subscriber to the monthly receipt of a My Vegan Box until the Customer decides to terminate this contract. 

My Vegan Box offers the two following formulas: 

  • A Classic Vegan Box, with a guaranteed value over 35 CHF in retail products. 
  • A Premium Vegan Box, with a guaranteed value over 55 CHF in retail products. 

By accepting the subscription, the Customer accepts a direct debit of the amount of the subscription at each renewal date of the subscription.  Thus, as long as the subscription continues, the Customer will be deducted from the sum, automatically at each renewal.

The subscriptions are without commitment. The Customer may pause or cancel his/her subscription at any time in accordance with the terms provided for in Article 6 “Pause and cancellation of the subscription” of these GCS.

The Customer has the possibility to offer My Vegan Box to the person of his choice from the “Gifts” page of the website. The Customer can purchase as a gift card the amount of any of the Classic or Premium subscriptions. Payment is unique.

The Customer undertakes to provide the correct email information of the person to whom the gift is offered, as well as to choose the date of sending of this gift email. 

The Gift Card will be send in digital format ONLY to the email address mentioned by the Client. 

The person who receives the Gift Card will also receive a unique code to deduct the amount of the gift card from his/her next purchase on www.my-vegan-box.ch

The Customer has the option of pausing or cancelling his subscription anytime. He can do so directly from its account, at least 7 (seven) days before the expiry of the renewal of his subscription to explicitly request the pause or cancellation of his subscription.

Subscription Customers can unsubscribe without obligation by respecting the termination period of 7 days before the renewal date. The renewal date can be viewed on the Customer’s account.

If the termination occurs after the direct debit has been made, the order is deemed to have been concluded for the month concerned, the subscriber cannot demand the cancellation of this order by citing his request for cancellation. The unsubscription is taken into account for the following month.

In the event of non-compliance with the obligations arising from the acceptance of these GCS, an order payment incident, the issuance of erroneous information when creating the account or acts likely to harm the interests of My Vegan Box, My Vegan Box reserves the right to suspend access to the services offered on the site or, depending on the seriousness of the acts, to terminate the subscription and the Customer’s account without notice and without damages being able to be claimed.

The prices of the products are indicated all taxes included (TTC).

My Vegan Box offers different payment methods depending on the type of purchase:

For subscriptions, the Customer can pay securely by debit or credit card. The Customer’s account will be debited periodically on the same date each month, except for the first shipment where the Customer’s account is debited when the subscription is taken out. With the validation of his order, the customer accepts the direct debit as follows:
– bi-monthly charge for bi-monthly subscription
– monthly charge for monthly subscription
– quarterly direct debit for the quarterly subscription
– half-yearly direct debit for the half-yearly subscription
– yearly direct debit for the yearly subscription

For any other order that does not include a subscription, the Client can choose between one of the following payment methods:
– by debit or credit card
– in cryptocurrencies accepted by the payment platform
– by the Kariyon card from the canton of Fribourg by contacting My Vegan Box by email.

For payments by credit card, My Vegan Box uses the secure Stripe platform as a service provider (see https://stripe.com). No payment data is stored or searchable by My Vegan Box.

The method of payment chosen by the customer will be used for subsequent renewals and orders, unless requested by the Customer to change.

The entire purchase process is fully encrypted and protected by SSL, provided by our hosting provider Hostinger (see www.hostinger.com). In accordance with the regulations in force, the bank details of Customers are not kept or recorded by My Vegan Box.

My Vegan Box offers different discounts that can be used by the Client.

  • Swissveg members benefit from a 10% discount on their subscription. The discount applies on each renewal of the subscritpion. The Swissveg Member must add the Swissveg discount to the first order and type his/her Swissveg member number in the dedicated area on Checkout page. If the number is not provided, My Vegan Box is allowed to cancel the discount from the initial order and all the renewals until a number has been provided. The Swissveg discount can not be applied with any other discount code.

 

  • Students benefit from a 10% discount on their subscription. The discount applies on each renewal of the subscritpion. The Student must apply the discount code “VEGSTUDENT” to the first order and send a copy of his/her student card by email at [email protected] If the copy is not provided, My Vegan Box is allowed to cancel the discount from the initial order and all the renewals until a number has been provided. The discounts applies on every renewal until the month mentioned on the student card. It is the responsability of the Student to send the new student card at the end of each cycle. If the new copy is not provided, an email will be sent from My Vegan Box and the discount will be removed from the following renewals. The Student discount can not be applied with any other discount code.

Other discounts may apply for promotional offers during the year. 

The products will be sent to the delivery address by the Swiss Post service. The delivery address is the one provided by the Customer when ordering. My Vegan Boxes are delivered on average between the 15th and 24th of each month. With the Swiss Post delivery, the average time observed varies between 2 and 5 days after the date of shipment, depending on your place of residence. This deadline is given as an indication and is not guaranteed by My Vegan Box. My Vegan Box cannot be held responsible for the consequences due to a delay in delivery.

– The delivery takes place only in Switzerland. For delivery abroad, the Customer will contact customer service to make the request. Delivery outside Switzerland is not guaranteed by My Vegan Box.

– Delivery costs are offered as part of the order. Deliveries are made to the delivery address mentioned by the Customer when ordering. A Delivery within one day or with signature will be requested at My Vegan Box and will result in extra fees for the Client.

– The first delivery (start of the subscription) is made the month following the date of the order, if it has been made and paid for before the last day of the month.

– If the person is absent, The Swiss Post will deposit the parcel in the auxiliary box/additional compartment. If a special space for packages is missing or if it is too small to accomodate the vegan box, the package will be collected by the Client from the nearest post office.

– If the delivery is not received by the Customer within the time limit set by the Swiss Post, and that the latter is in the wrong (negligence, forgetting, refusal, absence, wrong address, etc.), the Customer must then pay the return costs incurred of CHF 9.-. If necessary, the Customer may request a second delivery, at his own expense, by paying the delivery and packaging costs in advance, respectively CHF 11.-. The possibility of a second shipment is only possible within 20 days of receipt of the return by My Vegan Box, if the products delivered are available and suitable (eg expiry date).

– In case of delay, the Customer must contact Customer Service ([email protected]) who will provide him/her with the tracking number for investigation with the Post Office. A delay does not constitute in any case a reason for cancellation of the order and does not give right to any compensation.

– Anomaly on delivery. The Customer must check the shipments on arrival, or even refuse the package, if it seems to have been opened or if it shows obvious signs of deterioration. In the event of anomalies, the Customer must notify Customer Service within five (5) working days of delivery of the products. In order to take his request into consideration, the Customer must send the description of the anomaly as well as a good quality photo of the anomaly noted to the email [email protected] After this period, no complaint will be taken into account.

– Parcel returned. If the package must be returned to My Vegan Box, the return delivery will be at the Customer’s expense.

– Address change. In the event of a change of address, it is the Customer’s responsibility to notify it later on the 1st day the month the vegan box is shipped, by email to [email protected]

– My Vegan Box guarantees the traceability and origin of the products sold on this site. My Vegan Box does everything possible to deliver quality products to Customers and offer impeccable service. The Customer may make any comments by writing to [email protected]

– My Vegan Box undertakes to deliver a box each month with a minimum retail value of 35 CHF for the Classic Vegan Box and with a minimum retail value of 55 CHF for the Premium Vegan Box.

– My Vegan Box reserves the right to replace one or more products initially planned for the monthly vegan box, even if they are presented in the monthly brochure. This replacement may be due to stock or delivery unforeseen events. In this case, My Vegan Box undertakes to replace the product(s) concerned with one or more similar products, at least of the same value as the product(s) initially planned.

– My Vegan Box guarantees the quality of the products sold, in the preparation of which the greatest care is taken. However, My Vegan Box cannot be held liable for damages of any kind that may result from the misuse of the products.

It is up to the Customer to check the quantity and the good condition of the goods on delivery.

– Anomaly on delivery. The Customer must check the shipments on arrival, or even refuse the package, if it seems to have been opened or if it shows obvious signs of deterioration. In the event of anomalies, the Customer must notify Customer Service within five (5) working days of delivery of the products. In order to take his request into consideration, the Customer must send the description of the anomaly as well as a good quality photo of the anomaly noted to the email [email protected] After this period, no complaint will be taken into account.

– Parcel returned. If the package must be returned to My Vegan Box, the return delivery will be at the Customer’s expense.

– “Satisfied or your money back” policy. Refer to “Article 13. Satisfied or your money back” policy”.

One of the guarantee offered by My Vegan Box is the “Satisfied or your money back” policy.

If the Client is not happy with his/her first My Vegan Box, the Client can return to My Vegan Box and a full refund of the order will be given to the Client by My Vegan Box.

If the Client wishes to return the vegan box to My Vegan Box, he must contact the after-sales service ([email protected]).

The “Satisfied or your money back” policy only applies on the first vegan box received by a Client. The Client can not ask for the application of this policy on any following vegan box.

My Vegan Box will refund or cancel the invoice upon return of the box. However, the costs of returning the vegan box are the Client’s responsibility.

The Client has fifteen (15) days from the date of receipt of the order to return the box and request a refund. Obviously the products must not be opened, broken or tested.

My Vegan Box is always at the Client’s disposal for any questions relating to our concept and will always help the Customer find a solution that will delight him/her.

The personal data recorded on the site www.my-vegan-box.ch remain with My Vegan Box. They are fully protected and confidential and will never be used, transmitted or sold to third parties. My Vegan Box may use the data for information, promotions, news or to improve the services that may be offered to you.

– Subject to mandatory Swiss law, no claim for damages relating to a delivery covered by these conditions may exceed the amount of the purchase price of the products which gave rise to the claim for damages.

– Under no circumstances can My Vegan Box be held liable for indirect, incidental or consequential damages of any nature whatsoever arising in connection with its products, their use, their sale or this site.

– My Vegan Box cannot be held responsible for delay or lack of delivery resulting from circumstances beyond its control, such as accident, strike, war, natural disaster or others which would prevent the production, transport or delivery of products.

This contract, as well as the sales of subscriptions and other products by My Vegan Box, are governed by Swiss law. In the event of a dispute, the legal venue is Friborg and the procedures take place in French.
